Merit Solutions Pty Ltd is a specialist Human Resources (HR) consultancy with multi-faceted service offerings including recruitment, government selection support, contingent staffing, learning & professional development training and organisational consulting.

This Privacy Statement contains details about how Merit Solutions collects, holds, uses and discloses personal information about you for the purposes of recruitment and contingent staffing.

As a small business, we are not defined as an APP entity for the purposes of the Privacy Act 1988 (as amended). However, we will act ethically with your personal information and will comply with the Privacy Amendment (Private Sector) Act 2000 and the Australian Privacy Principles (APPs) set in the Privacy Act 1988.

1. Collecting and holding personal information

For the purpose of providing recruitment and contingent staffing services to you, we collect your personal information to assess your suitability and eligibility for future employment opportunities with Merit Solutions or our clients. We may collect personal information from you when:

  • you contact our office or one of our consultants via phone, email or in person to discuss our services;
  • you submit an enquiry using the webforms on our website;
  • you subscribe to receive information regarding our services;
  • you submit a job application for a position with Merit Solutions;
  • you submit an expression of interest for future job opportunities;
  • you submit a job application as part of a recruitment process we conduct for a client.

We may also obtain your personal information from our client to conduct recruitment and/or selection services on their behalf. Your personal information will only be used for its intended purpose.

You are under no obligation to provide us with your personal information, however if you choose not to, we may not be able to communicate effectively with you, provide you with the services you require or continue our relationship with you.

Merit Solutions uses the following external providers to collect and hold your personal information:

  • We use webforms provided by Vision 6 (an Australian based email marketing platform) to collect personal information through our website for bookings and general enquiries.
  • We use Recruit by the Scout Talent Group (an Australian based recruitment software platform) to collect and host personal information through job applications submitted to us.
  • We use Seek (an Australian based job-board and applicant tracking system) to collect and host personal information through job applications submitted to us.

Only approved personnel have access to these platforms.

2. Types of personal information we collect

Personal information is any information or opinion about you that makes you identifiable. The types of personal information we collect is dependent on how we engage with you and what services are related to your request. The types of personal information may include:

  • Personal details & contact details (name, contact number, address, email address, social media)
  • Your current job details and past career history
  • Qualifications and professional memberships you possess
  • Proof of Identify documents (such as birth certificate, driver’s license, etc)
  • Medical information (current and historic)
  • Criminal history (only attained with your expressed consent)
  • Vaccination status (only if it is a mandatory requirement by the client or workplace)
  • Confirmation of eligibility to work in Australia (such as Work Visa, Citizenship documents)

3. Providing us with personal information of a third party

It may be necessary for you to provide us with personal information of a third party, such as the details of a referee that you have nominated. It is important that you only do so with their expressed acknowledgment and consent, and that they can access or are provided with the Merit Solutions Privacy Policy should it be requested.

4. Using and disclosing personal information

Personal information will only be used and disclosed for its intended purpose in providing our services to you and/or our client. These may include:

  • communicating with you regarding your purpose for submitting your personal information;
  • assessing your suitability for the role you have applied for;
  • assessing your suitability for other roles that matches your skills and experience;
  • assisting in your work placement;
  • informing you of possible work opportunities;
  • undertaking criminal history checks (with your consent and only if required)
  • personalising our communications with you and promote our services to you
  • assisting in investigating your complaints, feedback and enquiries;

We may disclose your personal information to approved third parties including:

  • our contractors and consultants in order to perform services on behalf of our company or our clients;
  • clients who wish to engage you as a contractor, temporary employee or permanent employee;
  • your referees;
  • other entities with your consent or as permitted or required by law.

Personal information is only disclosed to approved third parties to perform the service provided. Under no circumstance will we sell your personal information to others.

5. Accessing or correcting your personal information or make a complaint

You may request access to the information we have collected about you, seek the correction of such information and make a complaint against us if you are of the view that we have breached any of the APPs or any related privacy code in dealing with your personal information. If at any time you wish to change personal information that is incorrect or wish to have your personal information deleted, please contact us with the details provided below. Unless personal information is required to be retained by us for administrative or legal reasons, we will meet such requests at the earliest possible opportunity.
